Water protection
Bodies of water must be protected as part of the natural environment and as a habitat for animals and plants in accordance with the Federal Water Act (WHG).
They must be managed so that they serve the general public welfare and in the process, they must serve the benefits of individuals as well. Preventable impacts that can compromise their ecological function must be stopped and sustainable development must be ensured.
The Federal Water Act (WHG) governs the usage conditions and requirements, e.g. discharging wastewater, wastewater disposal, the construction and operation of wastewater plants, and wastewater treatment systems, the regulations for water conservation areas, the conditions of plants for handling substances hazardous to water, as well as their monitoring.
Users of bodies of water who are allowed to discharge more than 750 cubic metres of wastewater on one day must appoint, in writing, one of several company officers for water pollution control (water protection representatives) according to § 64 WHG.
The consequences for a company include higher personnel costs and enormous amounts of additional work to guarantee that regulations are implemented in the day-to-day running of the company.

Which tasks does the water protection representative have?
The representative advises the user and the employees in issues that may be significant for water pollution control.
The representative is authorised and obligated to monitor compliance with regulations, conditions, and requirements in the interest of water pollution control and works towards ensuring the use of suitable wastewater treatment procedures.
Furthermore, the representative must also work towards developing and introducing company-internal procedures for avoiding or reducing the accumulation of wastewater and securing environmentally friendly production.
The company employees must be instructed about water pollution caused during operation and the equipment and measures implemented to prevent such pollution.
The water protection representative prepares an annual report for the operator concerning the measures intended as well as those that have been taken. Under certain circumstances, the representative can fulfil his reporting duties by incorporating participations in the municipal system for environmental management and environmental test (EMAS).
