According to the Federal Emissions Protection Act (BImSchG) people, animals, plants, ground, water, atmosphere and cultural and tangible assets must be protected against environmental influences and harmful environmental influences prevented.
In case of systems that are subject to licensing, the BImSchG is designed to prevent, or reduce, harmful environmental influences caused by emissions in the air, water and ground.
In addition, protection and prevention measures against hazards, significant detriments and substantial pollution are to be taken. There is also a series of associated obligations, such as the construction and operation of systems as well as monitoring and improving air quality.
Operators of systems that are subject to licensing must appoint one or several company officers for emission protection (emissions protection officer) according to § 53.
The consequences for a company include higher personnel costs and enormous amounts of additional work to guarantee that regulations are implemented in the day-to-day running of the company.

Which tasks does the emissions protection officer have?
The representative advises the user and the employees in issues that may be significant for emission protection.
The representative is authorised and obligated to work towards developing and introducing environmentally friendly procedures and environmentally friendly products as well as develop and introduce environmentally friendly processes and low-waste products.
If incident safety officers are not responsible for these tasks, the representative is authorised and obligated to work towards monitoring compliance with the regulations of German Federal Immission Control Act and the compliance with issued conditions and requirements (e.g. through measurements and emissions and pollution levels).
Furthermore, the representative is authorised and obligated to instruct the employees about the harmful environmental impacts that are caused by the system and the equipment and measures designed to prevent them.
The immission control officer prepares an annual report for the operator concerning the measures intended as well as those that have been taken.
